内容
Investment arbitration disputes have repeatedly come under heavy criticism for being too lengthy and costly. There is therefore a push within the UNCITRAL Working Group III and elsewhere to improve the system of investor-state dispute resolution. One way to resolve disputes more efficiently is to promote the use of mediation in investor-state disputes. This session will trace these such efforts for more efficiency, and in particular focus on the new Mediation Rules issued by the International Centre for Settlement of Investment Disputes (ICSID). It will also discuss some perceived obstacles to mediated settlements for states, and how they can be overcome. Furthermore, we will also examine the soon-to-be-released Decision Trees on investor-state mediation, which aim to provide simple guidance to investors and states alike as to when mediation appears particularly appropriate throughout the various stages of an investor-state dispute, with a potential parallel arbitration proceeding. The goal of the session is to show that investor-state mediation is of growing importance, popularity and usefulness in the resolution of disputes involving state actors.
