The use of third-party funding is growing exponentially in France and beyond. Through this mechanism, a non-party to the proceedings agrees to finance the case in exchange for a share of the proceeds should the claim succeed. While this practice is firmly established in investment arbitration, it has also gained increasing prominence both in commercial arbitration and more traditional international litigation. In Europe alone, the third-party funding market is valued at several billion euros. It has been employed recently in high-profile cases both in France and internationally, including the Sultan de Sulu case.
On the one hand, this mechanism is often viewed as a means of facilitating access to justice for impecunious parties who are unable to bear the costs of potentially lengthy and complex arbitral proceedings. On the other hand, it may raise significant practical challenges for arbitrators, arbitral institutions, and counsel. For example, the use of a third-party funder may give rise to difficult questions of independence and impartiality, especially when the funder has or has had connections with an arbitrator, who may not even be aware of the funder’s involvement.
While discussions surrounding the regulation of third-party funding are ongoing at the European Commission level, the practice has drawn criticism for the risks of abuse it may entail, as well as for ethical concerns about the increasing financialization of both arbitral and state justice systems by private economic actors. This presentation aims to explore and critically engage with these complex and evolving issues.
