内容
In 2013, the EU adopted a comprehensive Regulation on consumer ODR, the Regulation (EU) No 524/2013 (the “Regulation”). The settlement of trans-national consumer disputes has always been a key concern for the European authorities, as it is considered a fundamental tool to fully implement the free movement of goods in the single market. The speaker will present a preliminary analysis of the impact of the Regulation. This critical assessment will also be used as a basis for a broader reflection on the still unexpressed potential of ODR. Under this perspective, the presentation offers some suggestions on how to effectively implement successful ODR legislation based on the successes and pitfalls of several EU countries’ experiences. In particular, the presentation argues that a tool primarily conceived for solving cross-border consumer disputes may indeed be also used for domestic disputes, as well as for B2B differences.
